These Terms of Service (“Terms”) govern your access to and use of www.executiveaddictionrecoveryservices.com (the “Site”) and related online materials offered by Executive Addiction Recovery Services, operated by Brian Janes (“we,” “us,” or “our”). By using the Site, you agree to these Terms.

These Terms are a site-specific template prepared for informational purposes and should be reviewed by qualified legal counsel before being relied upon as a binding legal agreement.

1. About these services

The Site provides information about private, virtual addiction recovery education for executives and high-performing professionals, including the Strategic Recovery Course, optional counselling-related support, self-screening tools, blog/resources content, and a contact form. Services are offered virtually across Canada and the United States.

2. No emergency or crisis service

This Site is not a crisis, emergency, or suicide-prevention service. Content and tools here are not a substitute for emergency care. If you are in crisis, call or text 988. In an emergency, call 911 (or your local emergency number). Do not use the Site, contact form, or email to seek urgent help.

3. Use of the Site

You may browse public pages for personal, non-commercial information. You agree not to misuse the Site, attempt unauthorized access, interfere with security or hosting protections, scrape content at scale, submit unlawful or harmful content through forms, or impersonate others. We may suspend or limit access if we reasonably believe these Terms have been violated.

4. Educational course and optional support

The Strategic Recovery Course and related packages are educational, structured recovery programs delivered primarily through a private online platform (CoachAccountable), including dashboards, worksheets, and related program tools. Course materials and dashboards are for your personal use as a purchaser or authorized participant. Payment for the course or program is processed via CoachAccountable, not on this website.

Optional one-to-one counselling or psychotherapy support, where offered, is separate from general Site browsing and may be subject to professional standards, informed consent, and applicable regulation. Course enrolment alone does not create an ongoing clinical relationship unless separately agreed.

5. Screening tests

Self-screening tools on the Site (including SAST, MAST, and PGSI screens) are for personal reflection only. They do not provide a diagnosis, clinical assessment, or treatment recommendation. Results are processed in your browser for those tools and are not a substitute for evaluation by a qualified professional.

6. Disclaimers — not medical advice

Site content is for general information and education. It is not medical advice, and it is not a substitute for diagnosis, treatment, or advice from a qualified health professional. Brian Janes is a Registered Psychotherapist; descriptions of counselling or psychotherapy on the Site do not create a therapist–client relationship merely because you visit pages, complete a screen, or send an inquiry. Outcomes vary; no specific result is guaranteed.

7. Intellectual property

All Site content, branding, text, graphics, course curricula, and related materials are owned by Executive Addiction Recovery Services or its licensors and are protected by intellectual property laws. You may not copy, redistribute, or commercially exploit Site or course materials except as expressly permitted for your personal use under a purchase or these Terms.

8. Course payments and accounts

This website does not process course or program payments and does not operate an on-site shopping cart, checkout, or payment form. Enrolment fees and related payments for the Strategic Recovery Course and related programs are processed through CoachAccountable, a third-party platform used for program delivery and billing.

Prices, package features, payment plans, upgrades, taxes (such as HST where applicable), and refund terms are those presented at the time of purchase on CoachAccountable (or otherwise communicated to you in writing). CoachAccountable’s terms and privacy practices also apply to payment and account activity on that platform. Account credentials and dashboard access are for your personal use only.

9. Limitation of liability

To the fullest extent permitted by applicable law, the Site and materials are provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

To the fullest extent permitted by law, Executive Addiction Recovery Services, Brian Janes, and their service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities, arising from your use of the Site or reliance on Site content. Our aggregate liability relating to the Site (excluding paid professional services or course/program purchases governed by a separate agreement or by CoachAccountable’s purchase terms) will not exceed the greater of CAD $100 or the amounts you paid for Site-related services in the three months before the claim, where such limitation is allowed.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Ontario will have exclusive jurisdiction over disputes arising from these Terms or the Site, except where applicable consumer-protection law gives you non-waivable rights in another forum.

11. Privacy

Your use of personal information is described in our Privacy Policy, which forms part of how we operate the Site. By using the Site, you acknowledge that Policy.

12. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Site after changes constitutes acceptance of the updated Terms, except where applicable law requires additional notice or consent.
